At approximately 12:24 a.m. Aug. 20, UCAPD stopped a truck south of Bear Hall. He informed student Colby Murphy, 19, and his passenger, student John Miller, 18, they were being stopped for hitting the curbside.
Murphy retrieved his license and registration for the officer. He smelled of intoxicants and told the officer that he had been drinking earlier in the evening, but believed he was currently fine to drive. Seagram’s whiskey, Sauza tequila, an open Bud Light can and an empty bottle of Corona were found inside the vehicle.
The officer requested a breath sample from Murphy, which resulted in a BAC of 0.056.
The officer informed Murphy that his vehicle would be impounded and he would be issued citations for minor in possession and careless driving. Miller was issued a citation for minor in possession and no seatbelt.
Murphy informed the officer that there was more alcohol in a cooler in the bed of his truck.
The officer confiscated the remaining alcohol, took pictures to document it and had two other officers assist him in pouring it all out.
After issuing the citations, Murphy and Miller were both released to Bear Hall.
