Linda Hargis, a member of the Conway School Board, received a DUI Aug. 25.
Hargis, 76, was pulled over by Cabot police officer Korey Marcks for an improper lane change. According to the police report, Marcks saw a black Ford F-150 traveling east on West Main Street.
Marcks then “observed the pickup traveling in the middle of the two lanes while going east.”
According to the report, after the pickup turned left on West Locust Street, Marcks activated his emergency lights to conduct a traffic stop.
Marcks then made contact with Hargis and identified her as the sole occupant of her Ford F-150.
When Marcks engaged in conversation with Hargis, he “observed her eyes to be bloodshot and watery,” according to the report.
He also noticed the odor of alcohol coming from Hargis’s vehicle.
The report states Hargis was asked how much she had to drink tonight, she then admitted to drinking “two beers.”
Hargis was given multiple field sobriety tests and failed all of them.
After the field sobriety tests, she was given a breathalyzer test, where her blood alcohol content showed 0.14%.
The legal limit in the state of Arkansas is 0.08% according to alcoholrehabguide.org, once someone’s blood alcohol content reaches a 0.14%, “the depressant effects of alcohol starts to take effect, making them feel tired, anxious, or restless.”
According to the report, Marcks determined that Hargis was “not safe to operate a motor vehicle and was placed under arrest for a DUI.”
When Hargis arrived at the Cabot PD, she was given two more breathalyzer tests, where it showed 0.13% on both.
Hargis’ driver’s license was confiscated and she was issued a temporary license.
Marcks said since it is an ongoing investigation, he couldn’t answer any questions.
Hargis did not comment on her arrest.
She was booked into the Cabot Police Department, charged with a DUI and ticketed for an illegal lane change.
She has pleaded not guilty to both offenses and is scheduled for a bench trial Dec. 4.
Despite this, Hargis did attend a Conway School Board meeting Sept. 16 and her DUI was not mentioned.
