The Arkansas Attorney General’s office filed a $500,000 lawsuit against Conway company H2O Pools and Supplies at 921 Locust Avenue.
Arkansas Attorney General Tim Griffin sued H2O Pools and Supplies and the company’s owner, Victoria Harvey, March 24, after Griffin received 26 consumer complaints. The Better Business Bureau of Arkansas received five complaints and the Arkansas Contractors Licensing Board received seven complaints.
In each complaint, unhappy customers expressed the same frustrations against Harvey.
The lawsuit issued by Griffin reads, “After accepting consumers’ money for the construction of pools or the replacement of pool liners or other repairs, [the] defendants failed to perform their contracted services or provide the purchased goods. When consumers asked for proof that defendants had ordered the ‘pool kits,’ ‘supplies’ or ‘materials,’ defendants refused to provide receipts for use of the consumers’ down payments.”
The lawsuit states that the consumers paid over $500,000 to H2O Pools and Supplies to install or refurbish their pools, but H2O never completed the projects or reimbursed them.
“When consumers filed complaints, defendants either ignored them, failed to provide a solution, or gave the consumer a small amount of money in an apparent attempt to pacify the consumer, after which, defendants stopped responding to communications from consumers,” the lawsuit said.
Griffin issued the consumer alert in a tweet, “I filed suit against H2O Pools & Supplies from Conway for violations of the Deceptive Trade Practices Act. They took payments for pool installation & supplies, but failed to fulfill their promises.
“Arkansans have paid for pools at their homes but have been left with little more than holes in the ground,” Griffin said.
The trouble first stemmed two years ago when Daniel Priest, a resident of Greenbrier, sent a consumer complaint April 6, 2021, expressing his grievances about Harvey’s lack of service and communication.
In the complaint, Priest wrote that after putting down a pool kit deposit of $9,124, Harvey did not respond to any communication for the next eight months. The next time Harvey and Priest spoke, they agreed Harvey would refund Priest’s deposit.
Thirty days after that meeting, when Priest filed the complaint, the deposit still had not been refunded and Harvey stopped responding again.
In another complaint issued Aug. 20, 2022, Marlene Kelley of Conway requested a refund because of Harvey’s poor communication and the company’s lack of labor.
“A contract was signed for the installation of a swimming pool, it has been seven months since the contract was signed and half the money has been provided to Victoria Harvey. To date, Ms. Harvey is extremely difficult to reach about why the work has not been completed and is frequently dishonest about when work will resume. To date, no supplies have been purchased and only a few hours of labor have been provided,” Kelley’s complaint read.
A quick Google search of H2O Pools and Supplies will bring you to the company’s Yelp page, where it currently has one out of five stars.
The Yelp description for the company reads: “In todays world, more and more people are staying home to enjoy relaxing vacation time economically. In fact, “staycation” is rapidly becoming a household word to describe this new living style. We at h2o pools llc promise an eco friendly solution to make your home bonding time fun and economical while preserving natural resources.”
Reviews on the website, with photos of unfinished, pool structures with murky green water attached, share similar complaints to those received in the Attorney General’s office.
An anonymous reviewer with the username “Don’t be D.” wrote, “This has been the worst experience of my life!!! Victoria Harvey is a terrible person with no conscience!!! She is a thief!!! I’m not sure how she sleeps at night knowing she’s ruining everyone’s summers.”
Another user, simply called “Teri,” wrote “Do not trust Victoria Harvey …”
User Julio A.’s review echoed Teri’s, “These people are scum. Do not trust them.”
H2O Pools and Supplies did not respond to contact.
